Late this year the Ohio legislature finally passed a bill which will raise the state minimum limits in Ohio from $12,500 per person $25,000 per accident to $25,000 per person $50,000 per accident. This is a law which is well overdue! If you have followed my prior blogs, you realize that an issue I hold very dearly is that of insurance coverage. Once the Governor signs this bill into law, in 2013 Ohioians will have larger mandatory minimum limits. I still believe that these mandatory minimum limits are insufficient and Ohioians should carry larger limits than $25,000 per person $50,000 per accident; however, it is a start in appropriately insuring oneself. Remember Ohio to purchase as much uninsured and underinsured motorist coverage as you can afford. $25,000/$50,000 policy limits beat $12,500/$25,000 policy limits; however, $100,000/$300,000 policies beat them both! Further, in the bill pending before the Governor, the legislature in Ohio has also determined that the intrafamily exclusion which occurs in Ohio insurance policies is unenforceable in wrongful death situations. This is a significant change; however, the legislature did not go far enough. The intrafamily exclusion in Ohio policies is a horrible clause which continues to be enforced and the clause should have been overruled in all situations. It should not take the loss of life of a family member to prove to insurance carriers that there is no fraud involved in accidents involving family members.
